Anybody else watching this?  Diaz sounded like a bigot, Schneiderman sounded GOOD.  Just figured this would be a good place for a discussion, but can't embed the player.

"to not comply with what you promise is wrong!" he yelled, seemingly angry at [sic] the malcolm smith for not bringing a bill to the floor that he has no intention of voting on. "it's treason!"  (snipped from the village voice)

he accused senate president pro tempore malcolm smith of going back on his jpromise not to bring gay marriage to the floor.  "To go back on your word is treason," Diaz  (from tu's capitol confidential blog)
diaz is not calling the bill "treason."  he is calling the action of smith bringing the bill to the floor for vote after (allegedly)promising to not bring the bill to the floor for vote "treason."  smith breaking his (alleged) promise, not the bill itself, is what diaz is accusing of treason - and by extension, calling malcolm smith - not the bill - "treasonous"

this is not a matter of nuance.  words and the context in which they are used do mean something.  

diaz accusing malcolm smith of treason is a fine example of hyperbole.  i am absolutely positive diaz has never, EVER gone back on promises he has made...unless it was beneficial for him to do so, of course  (rolling my eyes)
i agree that he needs to go - i think of him as the senate's version of the assembly's (thankfully) retired arthur eve.

somewhat tangentally:  as i am not one of the constituents diaz may or may not represent, i have no business having a dog his re-election fight.  i am not naive about the workings of what passes for our state government.  it is corrupt to its core, a system in which there are few exceptions to "money talks no matter how much the constituents talk, where the campaign for re-election is perpetual, where legislation is rarely brought to the floor unless passage is assured, where legislators can hide from their respnsibilities to their constituents, choosing instead to place their loyalties and future elections in the hands of their party puppetmasters and assorted cash rich lobbies.

it is disgusting and saddening to be witness to how far removed from a representative democracy our legislature has become.  the finest example of this i know of is the legislatively printed pamphlet "how a bill becomes law"
it would be ironic comedy of the highest degree if how that process is described were remotely related to how a bill really becomes a law.  

though i am not delusional, i cannnot rid myself of my
nasty altruistic belief that regardless of party, an elected official should represent the will of the people who put them in office, not the will of the party or promises of pork or fear of having perpetual campaign contributions cut off by voting against those who lobby for legislation that a constituency for or voting for legislation a constituency is against.

if there is no clear concensus amongst a representative's constituancy, that representative is theoretically charged with the responsiblity and duty of voting his or conscience, thn let the voting chips fall where they may.  that, however, requires a backbone - a crucial part of anatomy largely absent in representatives in both chambers.
